Der Diebstahlsvorwurf ist <em>so<\/em> formuliert n\u00e4mlich vollkommen falsch. Das Br\u00f6tchen ist erst mal da, und klaut man es, ist es nicht mehr da wo es vorher war (normalerweise: es wechselt f\u00fcr gew\u00f6hnlich Ort\/Lage und Besitzer). Also wenn Brahms dem Beethoven seine 10. Sinfonie klaut und sie als seine 1. verkauft. Das ist Diebstahl. Dem armen Beethoven ist &#8220;sein Br\u00f6tchen geklaut worden.&#8221;<\/p>\n<p>Bei den nicht erlaubten Downloads ist es was anderes. Da nimmt man nicht etwas weg, sondern nutzt etwas, obwohl man das nicht darf ohne die erforderliche Erlaubnis. Oder man hat sie, dann darf man. In der Regel muss man daf\u00fcr etwas dem Rechteinhaber bezahlen. Das ist was anderes als mit dem Br\u00f6tchen. Wenn man das nutzt, ist es da weg, wo es war (in der Auslage). Und es ist nicht so, dass dem Nutzer ein Magenverwertungsrecht zugesprochen wird, das Br\u00f6tchen aber trotzdem in der Auslage liegen bleibt. <!--break--><\/p>\n<p>Da hilft es vielleicht weiter, wenn man einmal die Einkommenszust\u00e4nde ansieht, wie sie in der <a href=\"http:\/\/www.kuenstlersozialkasse.de\" title=\"KSK\">K\u00fcnstlersozialkasse<\/a> repr\u00e4sentiert werden.  Das j\u00e4hrliche Durchschnittseinkommen eines bei der KSK Versicherte, Bereich Musik betr\u00e4gt: <span id=\"dnn_ctr384_HtmlModule_HtmlHolder\" class=\"Normal\"><strong>9.459 Euro<\/strong>. Das ist so wahnsinnig viel nicht. Wenn also behauptet wird, es gehe vor allem den K\u00fcnstlern an den Kragen, so kann man sagen, mehr zu geht der Kragen aber auch nicht. <\/span><\/p>\n<p><span id=\"dnn_ctr384_HtmlModule_HtmlHolder\" class=\"Normal\">Und diese niedrigen Erl\u00f6se (in die auch Tantiemen einfli\u00dfen wie Aussch\u00fcttungen von Verwertungsgesellschaften sonst auch) sind nicht erst da, sei massenhaft CDs kopiert werden oder Soundfiles aus dem Internet &#8220;gesaugt&#8221; werden. Freilich sind nicht alle K\u00fcnstler in der KSK versichert, schon gar nicht die amerikanischen wie Prince oder Michael Jackson. Es sind nur <\/span><span id=\"dnn_ctr382_HtmlModule_HtmlHolder\" class=\"Normal\">40.264 (Stichtag 1.1.2006) im Bereich Musik. <\/span><\/p>\n<p>Die Kunst des Komponisten, wenn er von seiner T\u00e4tigkeit leben will, ist es die richtige Kunst zu machen oder aber einen guten Job zu haben. Im E-Bereich wird man sicherheitshalber Professor f\u00fcr Tonsatz oder Komposition &#8211; schlechterdings auch Klavierlehrer.<\/p>\n<p>Das Prinzip ist \u00e4hnlich wie in der Physik ein Ph\u00e4nomen, dessen Name und Prinzip mir gerade entfallen ist: Viel Geld bindet viel neues Geld. Wenig Geld hat wenig Bindung. Vor diesem Hintergrund ist die Frage der Kreativit\u00e4t ein Hohn. Es geht um Geldverteilung und nicht um Kreativit\u00e4t, den angeblichen Rohstoff der Zukunft.
