Die Abmahnenden meinen, die Grenzen dessen, was ein Zitat ist, seien eng. Wenn man also einfach sagt, dass Karl Valentin einmal sagte: &quot;Die Welt ist sch&ouml;n&quot;, dann ist da ein Ausspruch, der als Zitat eingef&uuml;hrt geh&ouml;rt oder als Belegstelle dienen muss,<\/p>\n<p>&quot;Kunst ist sch&ouml;n, macht aber viel Arbeit&quot; (Karl Valentin) einfach so zu sagen, weil es ein n&uuml;tzlicher Ausspruch ist, gen&uuml;gt nicht. Es geht nur im Zusammenhang. Also: Das Bild dort von dem Picasso ist wundersch&ouml;n, scheint aber nicht von nichts zu kommen, oder wie Karl Valentin richtig bemerkte: &quot;Kunst ist sch&ouml;n, macht aber viel Arbeit.&quot; Jedes Museum k&uuml;ndet von der Weisheit dieser Sentenz. Die Quelle m&uuml;sste man freilich auch noch genau wiedergeben: etwa so: Karl Valentin, Gesammelte Spr&uuml;che, Ort, Jahr, Seite. Erst dann ist das Zitat okay. Klar, man h&auml;tte jetzt auch mal Guttenberg fragen k&ouml;nnen, der wei&szlig; das ja auch.&nbsp;<\/p>\n<p>[<strong>Update:<\/strong>] Jetzt kommt noch der Fall des Buches &bdquo;Bl&uuml;hende Landschaften&ldquo; dazu. In diesem Buch soll es im Dokumentationsteil zum umfangreichen Zitaten von Fotos und Artikeln gekommen sein. Der Streit zwischen dem Autoren und der M&auml;rkischen Oderzeitung ging bis vor das <a href=\"http:\/\/www.urheberrecht.org\/news\/p\/1\/i\/4637\/\">BGH<\/a>. Dieses entschied, man muss noch einmal verhandeln. Von der Ferne aus kann man das nicht beurteilen. Aus der N&auml;he mag ich nicht. Interessant ist vielmehr, dass der Autor selbst lange Zeit Vorsitzender am Amtsgericht Eisenh&uuml;ttenstadt war. Die Schwierigkeit der Entscheidung des BGH zeigt ein bisschen damit auch das Dilemma auf, dass eben selbst juristische Profis in der Sache nicht alles wissen (k&ouml;nnen, wollen). Klar, das eine Gericht entscheidet so, das n&auml;chste anders. Immer eine Frage, welche Rechtsnormen man den Vorrang erteilt, welche Beweise wie gew&uuml;rdigt werden. Bis zu einem gewissen Ma&szlig;e ist das auch einfach die Normalit&auml;t des Rechts.
